1. You represent that you are a natural person over eighteen (18) years of age, that you reside in the United States, that you have a valid United States Social Security Number, that you may legally enter into this agreement, and that you agree with all the terms of this agreement. You further understand and agree that the services cover only your personal accounts that are directly associated with your valid United States Social Security Number.
2. Generations Gold, Inc., assumes no responsibility for errors or omissions in the information or other documents which are referenced by or linked to the web site. We will not be liable for any special, incidental, indirect or consequential damage of any kind, nor any damages whatsoever. Generations Gold, Inc. will not be liable for any failure or delay resulting from fire, explosion, flood, storm, act of God, government acts, orders or regulations, hostilities, civil disturbance, strike, labor difficulties, machinery breakdown, internet or telecommunications failure, reasons within your control, or any other similar event beyond the reasonable commercial control of Generations Gold, Inc. The services offered on this web site are provided "as is", with no warranties of any kind. We will not be liable for any damage you incur while using our benefits program and services, even if you advise us that such damages are possible.
3. Indemnification: You agree to indemnify, defend and hold Generations Gold, Inc., sponsoring financial institutions and organizations and any of its affiliates and all of their agents, directors, employees, information providers and licensors and licensees harmless from and against any and all liability and costs (including attorneys’ fees and costs) incurred by any of these parties in connection with any claim arising out of using this referral service.
4. Trademarks, Copyrights and Restrictions: and the logo are trademarks of Generations Gold, Inc. All promotional materials are copyrighted by Generations Gold, Inc. unless otherwise specified. All other product names and company logos found in promotional materials are the trademarks of their respective owners. All promotional materials are protected by copyrights, which are owned by Generations Gold, Inc. You may not reproduce, perform, create derivative works from, republish, upload, post, transmit, or distribute in any way any information without the express, written consent of Generations Gold, Inc.
5. You understand and agree that Generations Gold, Inc. is not an insurance company, is not a credit repair organization, is not a credit counseling service and does not promise to help you improve your credit history or rating. Generations Gold, Inc. will not provide you with advice or assistance in improving your credit history or credit rating and you understand and agree Generations Gold, Inc. will not make payments to you for any loss or liability you may incur other than lost document reimbursement as described herein.
6. Disclaimer: In no event shall Generations Gold, Inc. be liable to you or any party you enroll or cause to be enrolled for services for any indirect, special, incidental, consequential, or punitive damages, however and wherever arising; other than pursuant to the Restoration Service legal expense coverage defined herein. In no event shall the total liability of Generations Gold, Inc. under this agreement or regarding the services exceed the greater of one thousand dollars ($1,000) or the total amount you have paid for your Generations Gold, Inc. program. Some areas do not allow certain limitations of damages, so the foregoing may not apply to you.
7. Jurisdiction: This Agreement and any Service provided hereunder will be governed by the laws of the State of Florida, without regard to any laws that would direct the choice of another state’s laws and, where applicable, will be governed by the federal laws of the United States.
8. Other rights: You understand and agree that the Fair Credit Reporting Act as permitted by 15 U.S.C. 1681 allows you to obtain copies of annual credit reports for yourself and for minor children for whom you are the parent or legal guardian and opt-out of pre-screened solicitations and catalog mailings, without charge. You acknowledge and agree that it is illegal for anyone to obtain credit-related or other personal information concerning a minor child for whom they are not the parent or legal guardian and that any information you obtain about your minor child will be used solely for the purpose of assisting you in protecting your minor child against actual, suspected or potential fraud. Any minor children covered under this plan will automatically lose their eligibility the day before their eighteenth (18th) birthday. After this occurs, they will no longer be eligible for any benefits or coverage available under the Generations Gold, Inc. program. Accordingly, you also understand and agree that your decision to pay for and/or receive Services under this Agreement has been made by you as a convenience and is not legally required. You understand and agree that termination of your membership, for any reason, constitutes your consent to immediate termination of the program, open and active case files and Restoration Services provided by Generations Gold, Inc.
9. Miscellaneous: These terms and conditions may not be altered, supplemented, or amended by you using any other document(s). Any attempt to alter, supplement or amend this document or to enter an order for the Service which is subject to additional or altered terms and conditions will be invalid, unless agreed to in writing and signed by you and Generations Gold, Inc. The section headings used herein are for convenience of reference only and do not form a part of these terms and conditions, and no construction or inference will be derived there from. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable and shall not affect the enforceability of any other provision.
10. Obligations, Conditions and Exclusions: You agree that you are only providing your own personal information and not the information of any other individual, unless it is for a minor child for whom you are the parent or legal guardian. You understand that the information you provide during the registration process and any subsequent information you provide to Generations Gold, Inc. will be true, accurate and current. YOU ARE OBLIGATED TO CONTACT GENERATIONS GOLD, INC. MEMBER SERVICES IN THE EVENT THAT ANY INFORMATION YOU HAVE PROVIDED HAS CHANGED. You understand and agree that perfect security does not exist anywhere, and you take reasonable precautions to always protect and safeguard your Personal and Financial Information in a reasonable way. Accordingly, you will not recklessly disclose or publish your Social Security number or any other Personal Information to those that would reasonably be expected to improperly use or disclose that Personal Information, such as, by way of example, in response to "phishing" scams, unsolicited emails, or pop-up messages seeking disclosure of Personal Information. You acknowledge that it is your responsibility to exercise sound judgment when deciding whether and with whom to share your information is at your own risk. Additionally, you acknowledge and agree that neither we, nor any of our directors, officers, agents, employees, affiliated companies or financial institutions are responsible or liable to you for any actions taken or decisions made by any individual with whom you have shared your information. Should a bank or other credit institution, after reasonable investigation, determine that your reported loss is not due to identity theft; Generations Gold, Inc. may rely on such investigation to determine that the restoration service is not applicable to such loss.
11. You agree to remain in compliance with the following obligations and conditions and to take appropriate action:
o You must notify Generations Gold, Inc. within 30 days of the date you know, or reasonably should have known, that someone improperly used your Personal Information to commit a fraud.
o You must immediately notify all three major credit bureaus, the Federal Trade Commission’s Identity Theft Hotline, and appropriate law enforcement agencies.
o You must immediately notify the bank or card issuer in strict accordance with the banks or credit card issuer’s terms and conditions following the occurrence of an Unauthorized Fund Transfer.
o You must take all reasonable steps to mitigate any Loss resulting from a Stolen Identity Event including, but not limited to, requesting a waiver for any applicable fees, loan application fees, or credit bureau fees.
o You must willingly provide all assistance and cooperation required in the investigation and determination of any Loss.
12. Fraudulent Withdrawals by Family Members: Any loss resulting from an Unauthorized Funds Transfer will not apply if the action is committed by a family member of the covered member without signature authority on the affected Account.
13. An Identity Theft Event Not Reported Within Thirty (30) Days: This Policy does not apply if a stolen Identity Event or Unauthorized Funds Transfer is not reported to us within Thirty (30) days after it is first discovered by you.
14. Policy on Links to Third Party Web Sites: This web site contains links to third party web sites. Generations Gold, Inc. does not represent, guarantee, or endorse any web site that you may access from this web site. In addition, if we provide a link to a web site, we do not represent, guarantee, or endorse the company or any of its offerings. Links contained on this web site are provided solely as a convenience. When you access a non-Generations Gold, Inc. web site, you understand and agree that the linked site and its content are not under our control. Generations Gold, Inc. is not responsible for web casting or any other form of transmission received from any linked sites. You are responsible for protecting your system from such items as viruses, worms, Trojan horses, and other items of a destructive nature. You may be subject to additional terms and conditions that apply when you use third party sites, and you agree that you are responsible for reviewing and understanding any terms and conditions governing those sites and Generations Gold, Inc. has no responsibility, therefore.
15. A Stolen Identity Event means the fraudulent use of the insured s personal identification information, social security number, or any other method of identifying the insured. This includes, but is not limited to, the fraudulent use of the personal identity of the insured to establish credit accounts, secure loans, enter contracts, or commit crimes. Any loss resulting from stolen identity event(s) and arising from the same, continuous, related, or repeated acts shall be treated as arising out of a single stolen identity event occurring at the time of the first such stolen identity event. A Stolen Identity event will only be covered after the eligibility date.
16. A Stolen Identity event does not include the theft or unauthorized or illegal use of your business name, d/b/a, or any other method of identifying your business activity.
17. Generations Gold, Inc. will pay for your Restoration Rescue service performed by a Certified Restoration Specialist and in addition, if the Specialist determines an Attorney is necessary, we will pay for Attorney services up to a maximum of $5,000 per account per lifetime and reimburse you for only the following the cost of replacing covered documents, up to a maximum of $250 per primary account, per lifetime.
18. We reserve the right to request that you provide corroborating evidence with respect to any incident of Identity Theft of which we are notified, including signed sworn statements, law enforcement or governmental agency reports, or other corroborating evidence. Identity Theft Restoration Services may require you to sign a Limited Power of Attorney to act on your behalf. If you fail to provide any corroborating evidence requested, we reserve the right not to provide you with the features and benefits of this Identity Theft Restoration Service.
Identity Theft Restoration Services are not available in an unusual event that results in an inordinate number of identity theft victims such as a wide-ranging breach of personal information held by your credit card companies, financial institutions, etc. In addition, services will not be available when the member is responsible in whole or in part for causing or allowing the identity theft to occur or if we are unable to validate your activation and enrollment with a recorded transaction in our membership file. Identity Theft Restoration Services will not be provided to members who have enrolled after the identity theft event has occurred.
19.
a. Your Identity Theft Restoration Services must
be activated for each member in the membership account; your minor children are
automatically enrolled with your activation, and coverage begins ten (10)
business days from the date of your validated activation. Once activated, Generations
Gold, Inc. will pay for your Restoration Rescue service performed by a
Certified Restoration Specialist and in addition, if the Specialist determines
an Attorney is necessary, we will pay for Attorney services for primary membership
accounts and their minor children residing in the household, (up to the day
before their eighteenth (18th) birthday). The Identity Theft and Security
Center Program provides for Attorney s restoration service fees up to a maximum
of $5,000.00 per membership account, per lifetime with no deductible for
restoration service.
19. b. If your Identity Theft Restoration Services are automatic no activation is required, and your coverage automatically begins ten business days from the date of your enrollment. Be sure to visit the Identity Theft Program section to determine and verify that your coverage is automatic.
20. Coverage Territory: Subject to its terms, conditions and exclusions, this Coverage applies to a Stolen Identity Event or Unauthorized Funds Transfer occurring anywhere in the United States, or a branch or office abroad of a United States regulated Financial Institution.
21. In rare circumstances when additional work is deemed to be necessary (beyond the $5,000.00 covered amount), the member can opt to continue the services; however, any additional costs are the sole responsibility of the member.
22. If we find that you intentionally misrepresented damages or committed a fraud-related crime and misrepresented that you were our member when your information was misused, you agree to pay us back upon demand any amount we have paid in connection with your claim, including any costs we incur to collect the money from you. Being found guilty of a crime related to the loss which you attributed to identity theft is sufficient evidence to conclude that we are entitled to recover all amounts paid on your behalf as described above, but it is not the only basis upon which we may conclude.
You and Generations Gold, Inc. have entered into this agreement electronically, intending to be bound by your acceptance of this agreement, and acknowledge our privacy policy. We reserve the right, at our sole discretion, to change, modify, add or delete portions of this Agreement at any time without further notice. You should periodically visit this page to review the current Agreement so you are aware of any revision to which you are bound. Your continued use of the Services after any such changes constitutes acceptance and you agree to be bound by these terms and conditions.
